Pursuant to subsection 5.9(2) of the Aeronautics Act and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt applicants for an instrument rating from the examination prerequisite set out in paragraph 421.13(4)(d) of the Flight Crew Permits, Licences and Ratings standard, made pursuant to subsection 401.13(1) of the Canadian Aviation Regulations (CARs). This exemption is subject to the following conditions.
Subsection 401.13(1) Examination Prerequisites – states that prior to taking a written examination, an applicant for a flight crew permit, licence or rating shall meet the prerequisites for the examination set out in the personnel licensing standards.
Paragraph 421.13(4)(d) Examination Prerequisites - states that to be eligible to write the examination required, an applicant for an instrument rating shall provide proof of having completed a minimum of 20 hours of instrument flight or ground time.
PURPOSE
The purpose of this exemption is to permit applicants for an instrument rating to write the examination Instrument Rating (INRAT) without first acquiring the minimum 20 hours of instrument flight or ground time as stated in Paragraph 421.13(4)(d) of the CARs.
APPLICATION
This exemption applies to all applicants for an instrument rating – aeroplane or helicopter.
CONDITIONS
This exemption is subject to the following conditions:
- The applicant for an instrument rating shall:
- complete a structured program or course of study covering a list of subjects that includes all knowledge areas set out in the Study and Reference Guide – Instrument Rating – Aeroplane & Helicopter – TP691; and
- upon successful completion of the structured program or course of study, produce a signed letter of recommendation from the flight training unit responsible for the applicant’s instrument flight training. The letter shall be dated within 60 days prior to the date of the examination INRAT, and state that the applicant has completed the structured program or course of study, and has reached a sufficient level of knowledge to write the examination INRAT.
- The letter of recommendation required by this exemption shall only be used once. For any subsequent attempts, the applicant shall obtain a new letter that is compliant with condition 1b above.
VALIDITY
This exemption is in effect from August 1, 2008 until the earliest of the following:
- January 31, 2010 at 23:59 EST;
- The date on which an amendment to the appropriate provisions of the CARs or related standards comes into effect;
- The date on which any of the conditions set out in this exemption is breached; or
- The date on which this exemption is cancelled, in writing, by the Minister, where he is of the opinion it is no longer in the public interest or is likely to affect aviation safety.
